CLASS ACTION WAIVER: YOU AND THE PUBLISHER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.



Small Claims Exception: Not withstanding the above, either party may elect to have an individual claim heard in small claims court if the claim qualifies for that court's jurisdiction.
